Terms and conditions
Article 1. Purpose and Scope
These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") govern the sale of mobile connectivity services in the form of cards Prepaid eSIMs (hereinafter the "Products") offered by the company Miio, whose registered office is located at 60 rue François 1er, 75008 Paris, to its non-professional customers acting for their personal needs (hereinafter the "Customer"). Validation of an order implies full and unreserved acceptance by the Customer of these Terms and Conditions.

Article 3. Products (eSIM)
The Products sold are digital licenses allowing access to mobile internet abroad (data) via eSIM technology.
- Nature of the service: The service is a package deal data only. It does not allow the sending or receiving of traditional voice calls or SMS messages (only via VoIP applications such as WhatsApp or FaceTime).
- Validity: Each eSIM has a specific validity period and/or allocated data allowance, as detailed on the product sheet at the time of purchase.
- Functioning : Miio acts as a reseller of the service. The service is provided by third-party operators. Miio is committed to providing a valid and activatable eSIM.
It is the Client's responsibility to verify that their terminal is technically unlocked (Open to all operators). A device compatible with eSIM but locked to a specific operator will not be able to activate Miio Products, and no refund will be issued.»
Article 4. Ordering Process
Orders are placed exclusively on the Miio website. The process includes: selecting a plan, accepting the Terms and Conditions (via a checkbox), providing payment information, and making the payment. Final acceptance is confirmed by an order confirmation email from Miio.
Article 5. Service Activation and Delivery
- Delivery : The Product is a digital service. Delivery is immediate and is made by sending the installation QR Code (or manual code) to the email address provided by the Customer, upon confirmation of payment.
- Facility : Installation is the customer's responsibility. It requires a device. eSIM compatible and a Wi-Fi connection. Miio accepts no responsibility for any malfunction due to incompatibility of the Client's terminal or to user error.
- Activation: The eSIM is usually activated by connecting to the network once the customer arrives in the coverage area.
Article 6. Waiver of the Right of Withdrawal Clause
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium where performance has begun after the consumer's express prior consent and express waiver of his right of withdrawal.
The Client acknowledges and accepts that:
- The service is provided immediately after payment by sending the QR code.
- By checking the box to accept the Terms and Conditions and validating the order, the Customer gives their express agreement for the commencement of service provision before the expiry of the statutory 14-day period and expressly waives their right of withdrawal once the QR code is sent and the license is activated.
Article 7. Price and Payment Terms
Product prices are listed in Euros (€) or US Dollars ($), inclusive of all taxes (VAT). Payment is due in full at the time of ordering and can be made using the payment methods offered on the website. Miio reserves the right to change its prices, but products will be billed based on the rates in effect at the time the order is validated.
Article 8. Liability and Guarantee of Operation
- Warranty Limitation: Miio guarantees the technical validity and activation capability of the eSIM. However, Miio cannot guarantee the quality, speed or constant availability of the mobile network which depend on local operators, geographical conditions and network saturation.
- Exclusions: Miio cannot be held liable in cases of force majeure, malfunction of the Customer's terminal (incompatibility, incorrect settings), or roaming problems due to incorrect configuration by the Customer (e.g., roaming not enabled on the eSIM profile). Miio cannot be held responsible for service interruptions due to maintenance work by local operators, government decisions (internet outages), or natural disasters.
- Article 9. Miio Technical Assistance and Support
Miio provides email support and a callback service for diagnosing installation problems. This service offers first-level setup and troubleshooting assistance.
- Miio's role is to diagnose The problem is to attempt an immediate resolution of the configuration errors.
- In the event of an unresolved problem stemming from a malfunction of the license or the local operator's network, Miio will escalate the case to its technical supplier (Level 2) and will follow up with the Client.
Article 10. Refund Policy
Any refund is at the Miio's exclusive responsibility.
- Refund conditions : A refund can only be granted in the event of proven technical defect of the eSIM making data connection impossible, even after the Customer has followed Miio's support procedure and the fault has been confirmed as unresolved by Miio.
- Exclusions from Reimbursement: The following are not eligible for a refund: problems related to phone incompatibility, improper handling, weak network signal or non-use of the plan.
- Procedure : All requests must be submitted in writing to Miio, accompanied by evidence of the malfunction (screenshots, phone model, etc.).
Article 11. Applicable Law and Jurisdiction
These Terms and Conditions are governed by the French law. In the event of a dispute between the parties, and after an amicable solution has failed, the competent jurisdiction will be determined according to the rules of ordinary law. The competent court will be that of the district where Miio's registered office is located, namely Paris.
In accordance with the provisions of the Consumer Code, the Customer has the right to use a consumer mediator free of charge to resolve any dispute with Miio amicably. Before contacting the mediator, the Customer must have first attempted to resolve the dispute directly with Miio by submitting a written complaint. Article 12. Acceptance of the General Terms and Conditions
The Customer acknowledges having read these Terms and Conditions at the time of placing the order and expressly declares to accept them without reservation.
Article 13. Legal Guarantees
In accordance with French regulations, Miio is liable for defects in conformity of digital services sold under the conditions provided for by the Consumer Code and for hidden defects in the thing sold under the conditions provided for by the Civil Code.
13.1 Legal Guarantee of Conformity In accordance with Articles L.224-25-12 et seq. of the French Consumer Code, Miio is liable for any lack of conformity that appears during the entire period in which the digital content or digital service is provided under the contract. The Customer has two (2) years from the date the service is provided to take action. The Customer may request that the service be brought into conformity. Failing this, the Customer may request a price reduction or termination of the contract under the conditions provided by law.
13.2 Warranty Against Hidden Defects In accordance with Articles 1641 et seq. of the French Civil Code, Miio is also liable for hidden defects in the digital service sold that render it unfit for its intended use, or that so diminish its usefulness that the Customer would not have purchased it, or would have paid a lower price, had they been aware of them. The Customer must bring an action within two (2) years of discovering the defect.
